Terms of Use

The basis on which we publish property listings, and the terms that apply to consultants using the portal.

This policy is a template prepared for Shyam Property Mart and has not yet been reviewed by a legal professional. Before publishing, have an advocate confirm it against the Digital Personal Data Protection Act 2023, the Real Estate (Regulation and Development) Act 2016, and the current terms of your payment gateway. Company registration, GST and RERA details still need to be filled in.

1. Acceptance

By using this website or the consultant portal you agree to these terms. If you do not agree, please do not use the site.

2. What this platform is

We publish property listings and put interested parties in touch with consultants, advisors and developers. Except where we act expressly as your appointed broker under a separate signed agreement, we are not a party to any transaction between you and a seller, developer or consultant.

Nothing on this site is an offer, an invitation to offer, or a commitment to sell, lease or allot any property.

3. Listing information — please verify independently

This is the most important section on this page. Property information reaches us from consultants, owners and developers, and we do not independently verify all of it.

  • Prices, availability, carpet and built-up areas, plot dimensions, floor plans, payment schedules and possession dates are indicative and can change without notice.
  • Images, renders, elevations, layouts and site plans are illustrative. Actual construction, finishes, dimensions and surroundings may differ.
  • Amenities shown may be proposed rather than built, and may depend on approvals that have not yet been granted.
  • Distances, connectivity and neighbourhood descriptions are approximate.

Before paying any amount or signing anything, satisfy yourself independently as to title, encumbrances, approvals, permitted land use, and the accuracy of measurements. Engage your own advocate and, where relevant, a qualified surveyor.

4. RERA

Where a project is required to be registered under the Real Estate (Regulation and Development) Act 2016, you should verify its registration number and the filed project details on the RERA portal for the relevant state before committing to a purchase. Registration details published on a listing are supplied by the developer or consultant.

The agency’s own RERA registration number, where applicable, still needs to be added to this page.

5. Payments to developers and sellers

Booking amounts, token money, allotment payments, stamp duty and registration charges are paid by you directly to the developer, seller or the relevant authority. We do not collect them, do not hold them in trust, and are not responsible for their refund.

Always pay by traceable banking channels into a named account of the developer or seller, take a written receipt, and check whether the project requires payments into a designated RERA account. Never pay into the personal account of an individual agent.

6. Brokerage

Any brokerage or advisory fee, and who bears it, is agreed separately in writing before a transaction concludes. No brokerage is payable merely for browsing this site or submitting an enquiry.

7. Terms for consultants using the portal

  • You are responsible for the accuracy of every listing, price and photograph you publish, and for holding the rights to the images you upload.
  • You must have the owner’s authority to market a property before listing it.
  • You may not upload unlawful, misleading or infringing content, or content that misrepresents approvals, returns or possession dates.
  • Your account, inventory, leads and team are yours; you retain ownership of the content you upload and grant us a licence to host and display it while your account is active.
  • Subscription plans, listing limits and billing are described in the portal, and are subject to the refund and cancellation policy.
  • You must keep credentials confidential and are responsible for activity under your account and those of your admin and operations team.
  • We may suspend or terminate an account for breach of these terms, for unlawful conduct, or for repeated listing inaccuracies.

8. Acceptable use

Do not scrape, bulk-download or republish listings, attempt to breach access controls, probe other firms’ data, submit false enquiries, or use the site to send unsolicited marketing.

9. Intellectual property

The site’s name, logo, design and software are ours. Listing content remains the property of whoever uploaded it. You may not reproduce any of it commercially without written permission.

10. Third-party links

We may link to developer sites, maps and regulatory portals. We do not control them and are not responsible for their content or their handling of your information.

11. Availability

We aim to keep the site available but do not guarantee uninterrupted access. Features may change or be withdrawn.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from your reliance on listing information you did not independently verify, or from dealings between you and a developer, seller or consultant. Nothing here limits liability that cannot lawfully be limited, including for fraud.

13. Governing law

These terms are governed by the laws of India. The courts at Hapur, Uttar Pradesh have exclusive jurisdiction. Confirm this reflects where the business actually operates before publishing.

14. Changes

We may amend these terms. Continued use after a change means you accept the amended terms.
